A 64-year-old married husband, father and grandfather went to the local clinic complaining of, among other things, chest pain and/or heartburn. The records from that visit document 13 different references to “chest pain” and, under the cardiovascular heading, charts “burning sensation radiating to both arms and head.” The nurse practitioner diagnosed gastric reflux, prescribed Prilosec, and sent him to the hospital for an EKG. Two hours later, the results of the EKG were faxed back to the clinic. These results were “abnormal” and “suspicious of ischemia.” The nurse practitioner says she and her assistant made numerous phone calls our client and his wife, and supposedly left two voicemails asking him to call the clinic immediately. After securing both the phone records of the clinic and the clients, we were able to prove that no such calls were ever made. 14 hours after the clinic visit, he collapses and never regains consciousness. He’s airlifted to Terre Haute Regional, where a heart cath shows a 99% blockage of the RCA and a 90% blockage of the circumflex. He died two days later. The case was tried over four days near Bloomington. The jury returned a verdict in favor of his widow for $600,000.
