Our client, a highway construction worker, was profoundly injured when he was negligently struck by a vehicle operating in the scope of its business. The accident occurred in Davies County, Indiana. Our client was transported from the accident scene to IU Health Methodist Hospital via Lifeline helicopter. He had suffered a brainstem contusion and intercerebral hemorrhage, among other injuries. He was hospitalized for over a month, then admitted to a rehab facility. The defense relied on “inadequate signage” and “brake failure” arguments in an attempt to avoid liability, but in the end, the case settled for $7.38 million.
